House Rules
You must be at least 21 years old to book this property. No Smoking. No Parties. No Events. SHORT TERM RENTAL AGREEMENT Lease agreement (this “lease”) made _______________, between Desert Dreams LLC (the “Landlord”), and _________________________, of _____________________________________________________[address of Tenant] (the “Tenant”). In consideration of the mutual covenants and agreements contained in this lease, the Landlord leases to the Tenant and the Tenant leases from the Landlord the premises located at ______Joshua Tree, CA, upon the following terms and conditions: Section 1. Term This lease shall begin at 4:00 PM on ____________________and end at 11:00 AM on _______________________. Tenant shall not have the right to use the property before or after the duration of this lease. Landlord may approve of an earlier check-in or later check-out at the Tenant’s request. Section 2. Rent and Fees 2.1 The Tenant shall pay to the Landlord as rent a total of ___________________ for the term of this lease. 2.2 The Tenant shall be responsible for a $195 non-refundable cleaning fee. The Tenant is responsible for all taxes. If the Tenant has pets, they are responsible for a $125 pet fee. Jacuzzi heating is including in the nightly rate. Pool heating is $125/night 2.3 The Tenant shall pay all rent, fees, and taxes via the online rental marketplace where the Tenant made the reservation. Section 3. Security Deposit - Bookings via AIRBNB do not require security deposit 3.1 For the term of this lease, the Tenant further agrees to pay $300 as a security deposit, receipt of which the Landlord acknowledges, it being understood that the security deposit is not to be considered prepaid rent, nor shall any damages claimed be limited to the amount of the security deposit. Note if you booked via Airbnb, there is no security deposit as Airbnb uses Aircover. 3.2 The Landlord will submit to the Tenant an itemized list of any damages claimed to have been caused by the Tenant and return the entire security deposit less damages and other lawful deductions within 21 days after the termination of tenancy. 3.3 The Landlord may withhold all or part of the Tenant’s deposit if the Tenant fails to follow this lease, the rules of this lease outlined in Appendix A, the property listing, or the property house manual. 3.4 The Landlord may also withhold all or part of the deposit for damage to premises or contents; missing or broken items; lost keys; required excessive cleaning; the Tenant not complying fully with the departure checklist; smoke odors or damage; mailing charges for items the Tenant left behind; unauthorized persons visiting or staying on the property; noise complaints after 10 pm, including fines; trespassing on neighboring properties; extra cleaning or repairs necessitated by dogs; and unauthorized late check-out. 3.5 Landlord may deduct $200 from the deposit for unapproved dogs. 3.6 If the cost of damages, losses, or missing items should exceed the amount of the deposit, the Landlord may bill the Tenant’s credit card for the difference, up to the limit established by the online rental marketplace Terms of Service, and/or pursue legal action. Section 4. Covenants of Tenant The Tenant agrees that: 4.1 No more than _______ persons will occupy the premises overnight, including _______ adult(s) over 18 years old, _________ child(ren) aged 1-18 years old, and _______infants under 1 year old. The Tenant must have preapproval from the Landlord to have more than four additional guests during the day. 4.2 The Tenant will have no more than ________of dog(s) on the premises. No other animals are allowed on the premises. 4.3 The Tenant will be responsible for all damage, breakage, and loss to the premises, except for normal wear and tear. 4.4 The Tenant will leave the premises in the same general and good habitable condition as the premises were in at the beginning of the term of this lease. 4.5 The Tenant agrees to allow the Landlord to enter and view the premises, both inside and outside (1) to inspect the premises; (2) to make repairs to the premises; or (3) to show the premises to a prospective Tenant. 4.6 The Tenant shall dispose of all waste material generated during the rental period in the following areas: inside house trash containers, and inside the Laundry room. 4.7 The Tenant must notify the Landlord without delay if a fire alarm “chirps” or has a low battery condition. 4.8 The Tenant will read and follow the Additional Rules set forth in Appendix A. Section 5. Pets Dogs are allowed with prior written permission and with an additional cleaning fee. No animals or pets of any kind will be brought onto the premises unless with prior authorization. Dog owners agree to the following additional rules: 5.1 Tenant will use protective sheets that Landlord will provide to cover any place where Tenant’s dog may lie. 5.2 Outside the house dogs are to be leased or closely supervised at all times. 5.3 Owners must immediately pick up after their dogs and deposit waste in a plastic bag and place it in the outside garbage bin. 5.4 The Tenant is made aware that coyotes are in the area, which may attack dogs. 5.5 The Tenant is made aware that there are poisonous plants and rat control traps on the property, which may be harmful to dogs. 5.6 The Tenant releases the Landlord from liability for the death or injury to any pet on the property, including but not limited to harm resulting from coyote attacks, ingestion of rat poison, or ingestion of plants. Section 6. Sublet The Tenant shall not have the right to sublet the property. Section 7. Internet 7.1 The Landlord provides High-speed wireless internet as a convenience only and is not integral to the agreement. 7.2 No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service. 7.3 No illegal or abusive use of internet access is allowed. Section 8. Dangerous Materials 8.1 Neither the Landlord nor the Tenant shall keep or have on the premises fireworks or any article or thing of a dangerous, inflammable or explosive character that might substantially increase the danger of fire on the premises or that might be considered hazardous materials. 8.2 Only legally owned and permitted firearms shall be allowed on the premises in accordance with state and local laws. Section 9. Purpose The Landlord and the Tenant agree that the rental of these premises is for a vacation, transient, or recreational purpose, and the Tenants does not intend to make the property a residence or household. Section 10. Pool and Hot Tub 10.1 The Tenant agrees that the presence of the pool and/or hot tub (collectively referred to as pool) at the property creates a risk of personal injury or property damage. This risk is heightened as it relates to children. 10.2 The Tenant agrees to accept that risk and agrees to take all reasonable and proper measures to ensure the safety of the Tenant, its invitees, guests, agents, or licensees from injury or loss. 10.3 There is no lifeguard on duty. 10.4 Children under 14 are not permitted to use the pool without adult supervision. 10.5 The department of health prohibits diving in water depths less than 8 feet, swimmers should practice caution, and dive at their own risk. 10.6 Tenant agrees to release, indemnify, hold harmless and forever discharge the Landlord and the Landlord’s employees, agents, successors and assigns from any and all claims, liabilities or causes of action of any kind that the Tenant, members of Tenant's household or the Tenant's guests or invitees may have at any time against the Landlord or Landlord’s agents resulting from Tenant’s use of the pool. Section 11. Illegal Use Tenant shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause termination...
